Whole Potatoes

On December 30, 2009, the Canadian International Trade Tribunal, pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiated an expiry review of its order made on September 12, 2005, in Inquiry No. RR-2004 006, concerning the dumping of whole potatoes, excluding seed potatoes, excluding imports during the period from May 1 to July 31, inclusive, of each calendar year, and excluding red potatoes, yellow potatoes and the exotic potato varieties, regardless of packaging, and white and russet potatoes imported in 50-lb. cartons in the following count sizes: 40, 50, 60, 70 and 80, imported from the United States of America, for use or consumption in the province of British Columbia.

As a result, the President of the Canada Border Services Agency (the President) commenced an investigation on December 31, 2009, to determine whether the expiry of the order is likely to result in the continuation or resumption of dumping of the goods.

The investigation has now been completed and, on April 29, 2010, pursuant to paragraph 76.03(7)(a) of SIMA, the President has determined that the expiry of the order is likely to result in the continuation or resumption of dumping of the goods from the United States of America.

A Statement of Reasons containing additional details concerning the determination made by the President will be issued within 15 days. It will be posted at the following website: www.cbsa-asfc.gc.ca/sima-lmsi/er-rre/menu-eng.html.

The Tribunal will now conduct an inquiry to determine whether the expiry of the order is likely to result in injury or retardation to the Canadian industry, and is scheduled to make its decision by September 10, 2010.
